1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of https://balconydecking.sg (the “Site”) and any enquiries you submit through the Site to Balcony Decking Singapore (operating as BalconyDecking.sg) (“we”, “us”, or “our”).
By accessing the Site, submitting a form, or requesting a quotation, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2. About our services
We provide information and quotations relating to WPC (wood polymer composite) balcony decking and related outdoor flooring works for residential properties in Singapore, including condominiums and HDB flats. Website content (including material descriptions, pricing ranges, timelines, and design ideas) is for general information only and does not constitute a binding offer, professional engineering advice, or a guarantee of MCST/HDB approval.
3. Quotations and contract formation
- Prices, packages, and examples shown on the Site are indicative unless confirmed in a written quotation issued by us.
- A binding contract for supply and/or installation arises only when you accept our written quotation (or signed agreement) and any stated conditions are met, including deposit terms if applicable.
- Quotations may expire after the validity period stated in the quote. Site conditions discovered during measurement may require revised pricing.
- Photographs, samples, and colour descriptions are illustrative. WPC boards may vary in shade, grain texture, and finish by profile and batch.
4. MCST, HDB, and building approvals
Many condominium projects require Management Corporation Strata Title (MCST) or managing agent approval before balcony works. HDB flats may be subject to HDB renovation guidelines and other applicable rules. Unless we expressly agree in writing to prepare or submit applications on your behalf:
- You are responsible for obtaining all required approvals, permits, and neighbour or building access clearances before installation begins.
- We may pause or reschedule works if approvals, access, or building constraints are incomplete.
- Delays, redesigns, or extra works caused by approval conditions, building rules, or restricted working hours may incur additional charges as agreed in writing.
5. Customer responsibilities
You agree to:
- Provide accurate information about your property, balcony, and project requirements
- Ensure lawful authority to carry out the works at the premises
- Provide reasonable access for measurement, delivery, and installation during agreed times
- Inform us of known waterproofing issues, structural concerns, or building restrictions that may affect the works
- Keep the work area reasonably clear and secure pets/children during installation
6. Website use
You must not:
- Use the Site for any unlawful purpose under Singapore law
- Submit false, misleading, abusive, or spam enquiries
- Attempt to gain unauthorised access to the Site, servers, or related systems
- Scrape, harvest, or commercially reuse Site content without our prior written consent
- Introduce malware or otherwise interfere with the Site’s operation
We may suspend or restrict access to the Site at any time for maintenance, security, or operational reasons.
7. Intellectual property
All content on the Site — including text, graphics, logos, photographs, layouts, and branding — is owned by us or our licensors and protected under Singapore copyright and other intellectual property laws. You may view and print extracts for personal, non-commercial use related to evaluating our services. Any other reproduction or distribution requires our prior written permission.
8. User-submitted content
If you send us photos, measurements, or other materials for quotation purposes, you confirm that you have the right to share them and that they do not infringe third-party rights. You grant us a non-exclusive licence to use those materials solely to respond to your enquiry, prepare quotations, and perform related services.
9. Warranties and disclaimers
To the fullest extent permitted by Singapore law, the Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Product and workmanship warranties for paid projects, if any, will be set out in your quotation or written agreement and prevail over general website statements.
Nothing in these Terms excludes or limits any rights you may have as a consumer under mandatory Singapore law that cannot be excluded by contract, including applicable protections under the Consumer Protection (Fair Trading) Act 2003 where it applies.
10. Limitation of liability
To the fullest extent permitted by Singapore law:
- We are not liable for indirect, incidental, special, consequential, or punitive losses, or loss of profits, data, goodwill, or business opportunity, arising from your use of the Site or reliance on Site content.
- Our aggregate liability arising out of or in connection with your use of the Site (excluding separately contracted installation works) shall not exceed S$100.
- Liability arising from a paid project shall be governed by the applicable quotation or written agreement, and otherwise limited to the fees paid for that project, except where liability cannot be limited under Singapore law (for example fraud, or death or personal injury caused by negligence where such limitation is not permitted).
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or your failure to obtain required building approvals or provide accurate project information, except to the extent caused by our fraud or wilful misconduct.
12. Third-party services
The Site may link to third-party services such as WhatsApp. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party platforms we do not control.
13. Privacy
Personal data submitted through the Site is handled in accordance with our Privacy Policy and Singapore’s Personal Data Protection Act 2012 (PDPA).
14. Changes to these Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Singapore. Subject to any mandatory consumer rights, the courts of Singapore shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or your use of the Site. Before commencing formal proceedings, we encourage you to contact us so we can try to resolve the matter amicably.
16. General
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
- Our failure to enforce any right under these Terms is not a waiver of that right.
- These Terms, together with any accepted written quotation or agreement for a specific project, and our Privacy Policy, constitute the entire agreement regarding Site use and related enquiries. Project-specific terms prevail over website Terms to the extent of any conflict.
